Individual Bankruptcy in Malaysia
Under the Insolvency Act 1967, a creditor may petition for a debtor's bankruptcy where the debt exceeds RM100,000 and the debtor has committed an act of bankruptcy. We assist clients on both sides of bankruptcy proceedings.
For Creditors: Filing bankruptcy petitions, proof of debt submissions, attending and voting at meetings of creditors, and challenging voidable transactions and preferences.
For Debtors: Opposing or setting aside bankruptcy petitions, negotiating voluntary arrangements, applying for annulment, and advising on discharge from bankruptcy.
