Understanding Child Custody in Malaysia
Malaysian civil law recognises two main types of custody: sole custody, where one parent has exclusive rights to make major decisions about the child's upbringing, and joint custody, where both parents share decision-making responsibilities for the child's welfare. Regardless of the custody arrangement, the non-custodial parent typically retains access rights to maintain a relationship with the child.
Custody Considerations
Civil courts determine custody based on the child's best interests, considering the child's age and wishes if of sufficient maturity, each parent's ability to provide for the child's physical and emotional needs, the child's current living arrangements and schooling, each parent's character, conduct, and health, and any history of domestic violence or abuse.
Child Maintenance Under Malaysian Law
Parents have a legal obligation to maintain their children financially until they reach 18 years of age, or longer if the child has disabilities or is pursuing further education. Maintenance typically covers food, clothing, accommodation, education expenses, medical and healthcare costs, extracurricular activities, and other reasonable necessities.

Enforcement of Custody and Maintenance Orders
