Grant of Probate & Letters of Administration in Malaysia
When a person passes away, the legal authority to deal with their estate must be established before assets can be administered or transferred. This is done through a Grant of Probate or Letters of Administration obtained from the High Court.
What is a Grant of Probate?
A Grant of Probate is a court order issued by the High Court of Malaya that authorises the executor named in a valid will to administer and distribute the estate in accordance with the terms of the will.
It is required where the deceased left a valid will and there are assets to be administered.
What are Letters of Administration?
Letters of Administration are granted when a person dies intestate, that is, without a valid will. The court appoints an administrator — ordinarily a family member or next of kin — to manage and distribute the estate in accordance with the Distribution Act 1958.
