Estate Administration

Estate Administration & Distribution

Once the necessary grant or order has been obtained, the executor or administrator is responsible for collecting estate assets, settling liabilities, and distributing the remainder to beneficiaries.

Estate Administration & Distribution

We assist executors and administrators at each stage of the process, from asset identification and liability settlement through to distribution of the estate.

Scope of Assistance

  • Applying for Grant of Probate or Letters of Administration where not yet obtained
  • Identification and valuation of estate assets
  • Settlement of estate debts and obligations
  • Tax clearance and compliance matters
  • Distribution of assets to beneficiaries
  • Assistance in resolving disputes during administration

Legal Framework

Estate administration in Malaysia is governed by the Probate and Administration Act 1959, the Distribution Act 1958 for non-Muslim intestate estates, and the National Land Code for property matters.

Muslim estates are subject to Islamic inheritance law (Faraid) and are administered through the Syariah courts where applicable.

Practical Considerations

Executors and administrators carry personal legal responsibility for proper administration of the estate. Assets should be properly identified, debts settled before distribution, and distribution carried out in accordance with the will or law.

We advise clients on their obligations at each stage and assist in managing the process through to completion.
